The Brief should include the following:
• Facts: All legally relevant facts and the source of the facts to support the arguments set forth in the Brief for the requested
relief.
• Issue (question presented): The issue should be phrased based on the cause of action for which summary judgment is
sought (if filing for the Plaintiff) or for which the dismissal is sought (if filing for the Defendant). There should be one issue in
the Brief. The issue should be phrased as a question.
• Short Answer: The short answer is the concise response to the question presented (the issue).
• Legal Argument (legal analysis): The legal argument should be 3-4 pages in length.
o The legal analysis should include the rule (either summary judgment or motion to dismiss) and a minimum of five cites
to primary, binding authority that are still considered good law in the jurisdiction.
o Statutory and case law should be included in the analysis.
o Fully build out the connections between legally relevant facts, cited authority, and the bridge between the cited authority
and the case information.
o Analysis should support the application of the authority to the issue to provide the foundation for the requested relief.
o Focus should be on drawing parallels, or drawing distinctions.
o Analysis should demonstrate how the legal requirements for the requested relief have been established.
• Conclusion: The conclusion should recap the request for relief, focusing on the application of the law to the facts to support
the requested relief and summarizing how the legal requirements for the requested relief have been established.
