ABSTRACT
This thesis is intended to study the problems of using criminal law in the theft of crimes in
accordance with Article 335 in order to know the suitability of the current situation due to Thailand that has
changed and developed economically very much There is a technological advancement that gives people access
to the rights that the government and private recruitment and services are available to people of all ages. At
present, the theft of crimes in Section 335 has some sources that may not be suitable for the current situation,
such as theft at night, according to Section 335 (1), that is, if there is a crime of theft. At the time between sunset

and sunrise the offender must be punished under Section 335 (1), which is subject to heavy penalties from
Section 334. However, if the fact that the perpetrator has stolen the department store or convenience store

opened at night at the time Between the sunset and the sunrise will affect justice for the perpetrator to be

punished harder because the offender Users require darkness as a tool to help make the theft more convenient

because there is lighting inside the building already.
In addition, at present, people of all ages and ages have more convenience in living with the help of

both the public and private sectors, but from the study of the criminal law of Thailand, there is no provision for

protecting people who experience problems of living due to physical or mental defects such as people with
disabilities.

In this thesis, the author, therefore, suggested that the Criminal Code should be revised in Section

335 (1) by abolishing the offense according to such subdivisions for the current situation. And proposing

additional criminal codes by prescribing the theft of persons who are unable to protect themselves from being
disabled People with mental disabilities, sick people, old people, and pregnant women is another critique of the

provisions of Article 335. The author has adopted the principles of foreign law, including the United States of

America Germany and France In the case of burglary offenses in the crimes of which the offender is to be
punished harder than the general burglary as a guideline to improve the Thai Criminal Code to make law

enforcement more effective.
