A pena de morte para crimes comuns foi abolida em Portugal a 1 de julho de 1867.
Antes, em 5 de julho de 1852, por via do Ato Adicional à Carta Constitucional, havia já
sido abolida a pena de morte para crimes políticos.
Todavia, desde 1846 ninguém havia sido executado em Portugal, sendo que a última
execução de uma mulher ocorreu em 1772.
A Constituição republicana de 1911 aboliu também a pena de morte para crimes militares.
Porém, em consequência da participação portuguesa na I Grande Guerra, esta voltou a
ser reintroduzida no Código de Justiça Militar em 1916, tendo resultado de tal alteração, pelo
menos, uma execução no teatro de operações, em 16 de setembro de 1917.
Apesar de esta pena militar ter sido mantida até à aprovação da Constituição da Repú-
blica Portuguesa em 1976, a verdade é que não há conhecimento de ela ter voltado a ser apli-
cada em Portugal por qualquer tipo de tribunal.
Se excetuarmos o caso da pequena República de São Marinho, Portugal foi o primeiro
país europeu de alguma dimensão a abolir a pena de morte.

In Portugal, the death penalty for common crimes was abolished on 1 July 1867.
Earlier, on 5 July 1852, the death penalty for political crimes had already been abolished
by way of the Additional Act to the Constitutional Charter.
However, nobody had been executed in Portugal since 1846, and the last execution of a
woman had taken place in 1772.
The new 1911 Republican Constitution also abolished the death penalty for military crimes.
Nevertheless, as a consequence of Portugal’s participation in the First World War, the
latter was reintroduced to the Military Justice Code in 1916, and this alteration resulted in at
least one execution in the theatre of operations on 16 September 1917.
Although this military punishment was kept until the approval of the new Constitution
of the Portuguese Republic in 1976, the truth is that there is no knowledge of its being applied
by any kind of Portuguese court.
