Foram a inteligência, a capacidade e a sensibilidade política e humana dos responsáveis
políticos portugueses para abordar aquela realidade que permitiram estabilizar a sociedade e
ultrapassar os traumas anteriores.
E, afinal, é a pacificação da sociedade que, no fundo, constitui o objetivo fundamental da
política criminal.
Os exemplos da Itália e da Espanha são, neste aspeto, extraordinariamente significativos.
Ambos os países lidaram, em anos recentes, com fenómenos graves de terrorismo sem
introduzir a pena de morte e mantendo, em geral, regras processuais comuns para julgar os
responsáveis pelas organizações e atos terroristas.
Apesar disso, os fenómenos de terrorismo, então causadores de tantas vítimas, parecem
ter-se esgotado.
Os exemplos corajosos daqueles países, no que respeita às políticas para enfrentar o
terrorismo, tiveram várias e importantes consequências.
Umas, de natureza interna, outras, com repercussões externas e internacionais.
Esses exemplos pacificaram, desde logo, as respetivas sociedades.
Tornaram possível que, nos nossos dias, o próprio estatuto do Tribunal Penal Internacio-
nal não tenha aceitado a pena de morte como uma punição admissível para crimes de idêntica
natureza.

Some of them have publicly admitted to their crimes and, more importantly, to the
complete wrongness of their actions (even from a political standpoint).
The courageous testimony of those men and women was much more effective in dis-
suading their potential followers from somehow following their paths and avenging their
sentences than if they had been sentenced to death.
Had they been sentenced to death they could have become martyrs and symbols for
political heroism and, possibly, the terrorism would continue.
It was the political and humane capability, intelligence and sensibility of the Portuguese
authorities to handle that reality that allowed us to stabilise society and overcome previous
traumas.
After all, the most important goal of criminal policies is to bring peace to societies.
Spain and Italy are extremely important examples in this matter.
Both countries have recently dealt with serious terrorism without falling into the temp-
tation of reintroducing the death penalty and have generally kept common procedural rules
for bringing those responsible for terrorist organisations and acts to justice.
Nevertheless, the terrorism attacks, causing so many victims, seem to have been
exhausted.
