A não (re)introdução da pena de morte no tratado que criou aquela jurisdição internacio-
nal constituiu, pois, um avanço considerável no caminho da sua abolição universal.
Podemos, por isso, afirmar que este facto – a recusa da previsão da pena de morte nos
instrumentos legais que se aplicam em tão importante jurisdição – contribuirá, seguramente,
para esse objetivo.
Portugal – recordemos uma vez mais – jogou também aqui um papel decisivo.

A União Europeia inscreveu, entretanto, na sua estratégia de cooperação com países terceiros,
a relevância da defesa da democracia e dos direitos humanos e, por consequência, a preocupa-
ção com a abolição da pena de morte.
Será importante que quaisquer condicionalismos supervenientes não venham a pertur-
bar, agora, esse objetivo fundamental para a identidade europeia.
Na verdade, o mais importante direito humano a defender é o direito à vida; sem conse-
guir assegurá-lo, de nada valem todos os outros.
Ter a coragem e a capacidade para garantir que o direito à vida constitui um direito fun-
damental – até para aqueles que cometeram crimes graves – será provavelmente a chave para
mudar a mentalidade que conduz à guerra, ao terrorismo e à violência.

The courageous examples of those countries regarding criminal law policies against ter-
rorism have had many important consequences.
Some are national in scope while others have foreign and international repercussions.
These countries have brought peace to their societies.
They have made it possible for the statutes of International Criminal Court to exclude
the death penalty as an acceptable punishment for crimes of a similar nature.
The abolition of the death penalty seen in the treaty that set up the international court
is a major step towards the universal abolition of the death penalty.
We can thus say that this fact – the refusal to include the death penalty in the legal
instruments of the International Criminal Court – will definitely contribute to this goal.
Once again we should recall that Portugal played a decisive role.

In its third-country cooperation strategy, the European Union has included the importance of the
defence of human rights and democracy and therefore concern for the abolition of death penalty.
It is crucial that any constraints arising from these efforts do not interfere with this
fundamental goal for a European identity.
