Fundamental ao impor a abolição da pena de morte em Portugal no âmbito da justiça civil,
a Carta de Lei de 1 de julho de 1867 define igualmente uma reforma penal e das prisões de
alcance considerável. Em conjunto com a Carta de Lei publicada no dia seguinte, a 2 de julho de
1867, que autoriza a criação e a organização dos corpos de Polícia Civil, estes diplomas legais
constituem elementos centrais do longo percurso de reformulação e modernização do sistema
penal, prisional e policial no Portugal oitocentista.
O crime, o seu significado e causas, as formas de o prevenir e reprimir, constituem rele-
vantes questões de debate e reflexão em Portugal, envolvendo autoridades públicas, estu-
diosos e a sociedade de forma participada. No debate e ação políticos, a reforma do sistema
penal manteve -se sempre presente ao longo do século xix, com reflexões, tomadas de posição,
medidas legislativas e concretizações diversas, sobretudo intensas no período de 1851 a 1886.
São reformas implementadas num quadro de forte intercâmbio de ideias e conhecimentos,
debates e observação do que se defende e é implementado noutros territórios, tanto na Europa,
como no continente americano.

As well as being fundamental for imposing the abolition of the death penalty in Portugal for
civil justice, the Charter of Law of 1 July 1867 also established a considerably wide-reaching
reform of the penal system and prisons. Together with the Charter of Law published the fol-
lowing day, 2 July 1867, which authorised the foundation and organisation of the different
bodies of the civil police, the two laws are the central features in a long journey to reform and

Crime, its significance and causes, and ways of preventing it and limiting it were important

throughout the 19 century, and included reflections, positions taken, legislative measures and
